Abstract
international community is the right to health. Health is considered one of the most important components of respect for the principle of human dignity. The right to health has been considered as one of the fundamental human rights in the international legal system. The areas related to the right to health are very diverse and include various dimensions. The main innovation of this article compared to other research and studies conducted in this field is to present an applied concept to explain the right to health. In addition, the opinion of lawyers in a comparative approach has been explained to provide an appropriate definition. There are various and numerous documents in the international arena and in the domestic laws of countries to protect the right to health, among the ambiguities created in this area is the discussion related to the possibility of using e-health in the field of health rights. Electronic health records, decision support systems, electronic prescription and electronic consultation, and telemedicine are among the most important sub-categories of electronic health. In some cases, the use of electronic tools for health development violates human rights rules. In this article, we will explain these cases and evaluate the performance of the international community and countries in this area.
