The right to health is not just one of the examples of human rights, but this concept should be interpreted as a set of rights and freedoms that are guaranteed by governments so that every human being can enjoy the highest level of health standards to benefit physically and mentally. This issue includes high quality health care and healthy living conditions. In this article, the right to the health of the elderly was analyzed with a descriptive-analytical method and the use of library resources, emphasizing the international norms of human rights. Examining the international and regional documents in which the right to health of different sections of the society is discussed in general, as well as the human rights soft law that pay special attention to the rights of the elderly, such as The Vienna International Plan of Action on Ageing (1982), The United Nation Principles for Older Persons (1991), Madrid International Plan of Action on Ageing and also some of European Court of Human Rights Judgements show that international community expected a special protection of the elderly regarding the right to health of these groups by ratification of a treaty. This treaty should contain norms that require governments to adopt a human rights-based approach and take measures in all areas of the elderly's life, especially in the field of health.
